Terms of Service
These Terms and Conditions of Sale apply to all Orders that the Buyer places with True Gent Tattoo Supplies and set out the terms in relation to the Seller supplying Goods to the Buyer.
By placing an Order, the Buyer acknowledges and agrees that they shall be bound by these Terms.
Interpretation
In these Terms and Conditions, the following words and phrases shall have the following meanings:
“Buyer” means the person, firm or company who purchases the Goods from the Company.
“Company” means True Gent Tattoo Supplies and any associated trading names.
“Contract” means the contract between the Company and the Buyer, which shall be deemed to incorporate these Terms.
“Goods” means any goods agreed in the Contract to be supplied by the Company to the Buyer.
“Place of Delivery” means the place to which the Goods are to be delivered.
References to any statute or statutory provision shall be construed as a reference to such statute or statutory provision as amended, modified, re-enacted or replaced from time to time.
The Contract
The Contract shall be on these Terms to the exclusion of all other terms and conditions, including any terms and conditions that are purported to be included or applied by the Buyer.
No terms and conditions contained in the confirmation of order, purchase order or other document of the Buyer will form part of the Contract.
Age Restrictions
Certain products sold by the Company are intended strictly for professional use and may only be purchased by persons aged 18 years or over.
By placing an Order, the Buyer confirms that they are at least 18 years of age and legally permitted to purchase and use the Goods ordered.
The Company reserves the right to refuse, cancel or delay any Order where age verification cannot be satisfactorily completed.
Delivery
Any dates specified by the Company for delivery of the Goods are intended to be an estimate only. If no date is specified, delivery shall be within a reasonable time.
Every effort will be made to meet forecast delivery dates, however the Company cannot accept liability for any loss arising from failure to meet them.
Subject to the other provisions of these Terms, the Company shall not be liable for any loss, whether direct, consequential, economic, loss of profits or otherwise, arising directly or indirectly out of any delay in delivery.
Any delay will not entitle the Buyer to terminate or rescind the Contract unless the delay exceeds 60 days.
Stock Availability
All Orders are subject to product availability.
The Company reserves the right to withdraw products from sale, limit quantities, part-ship Orders, or cancel Orders where stock becomes unavailable.
If an item becomes unavailable after an Order has been placed, the Buyer will be notified as soon as reasonably possible and offered a refund or alternative product where appropriate.
Incorrect Pricing and Website Errors
Whilst every effort is made to ensure product descriptions, images, pricing and availability are accurate, errors may occasionally occur.
The Company reserves the right to correct any errors, inaccuracies or omissions and to cancel or refuse any Order placed where product information, pricing or availability has been incorrectly displayed, whether or not the Order has been confirmed or payment taken.
Where payment has already been processed for an affected Order, a full refund will be issued.
Returns
Returns are accepted only in accordance with the Company’s returns policy and any applicable consumer rights.
Goods must be returned unused, unopened and in their original packaging unless faulty.
The Buyer must contact the Company before returning any Goods.
The Company reserves the right to refuse returns where Goods have been used, damaged, opened, altered, or are not suitable for resale, unless the Goods are faulty.
Risk and Ownership of Goods
Risk in the Goods shall pass to the Buyer on delivery.
Ownership of the Goods shall not pass to the Buyer until the Company has received full payment in cleared funds for the Goods and all other sums due to the Company from the Buyer.
Until ownership has passed to the Buyer, the Buyer shall:
- hold the Goods on a fiduciary basis as the Company’s bailee;
- store the Goods separately from all other goods of the Buyer or any third party so they remain identifiable as the Company’s property;
- not destroy or deface any identifying mark on the Goods or their packaging;
- maintain the Goods in satisfactory condition.
The Buyer must at all times be satisfied that the Goods ordered are suitable for their intended use. The Company cannot accept liability for the way products are stored or used after delivery.
Professional Use Disclaimer
Products sold by the Company are intended for professional tattoo use only unless otherwise stated.
The Buyer is solely responsible for ensuring that all Goods are used safely, hygienically, legally and in accordance with manufacturer guidance and local regulations.
The Company accepts no liability for misuse, improper handling, incorrect storage, unsafe application, or use by unqualified persons.
It is the responsibility of the Buyer to ensure that the products ordered are suitable for their intended purpose.
Price
The price for the Goods shall, unless otherwise agreed, be the price set out on the Company’s website or price list at the time of order or dispatch.
Prices are exclusive of carriage, insurance and applicable VAT unless otherwise stated.
The Company reserves the right to amend prices to those ruling at the date of dispatch.
Payment
Payment shall not be deemed to have taken place until the Company has received cleared funds.
Warranties
The Company warrants that the Goods are of satisfactory quality.
If the Buyer wishes to make a claim under this warranty, the Buyer must give written notice to the Company within 30 days of discovering the defect and give the Company a reasonable opportunity to inspect the Goods.
The Company shall not be liable for any breach of warranty if the Buyer makes further use of the Goods after giving notice, or alters or repairs the Goods without the Company’s agreement.
The Company’s liability under the warranty shall be limited to arranging repair, replacement, or refunding the price of the Goods in question.
Limitation of Liability
The Company’s liability in contract, tort or otherwise arising out of the subject matter of the Contract shall not exceed £1,000.
The Company shall under no circumstances be liable to the Buyer for any consequential, indirect or economic loss or damages.
Nothing in these Terms shall exclude or limit liability where it would be unlawful to do so.
Fraud Prevention
The Company reserves the right to refuse, cancel or place on hold any Order suspected of being fraudulent, unauthorised, connected to illegal activity, or in breach of these Terms.
The Company may carry out additional verification checks, including identity, address and payment verification, before dispatching Goods.
Failure to provide requested verification information may result in cancellation of the Order and refund of payment.
Website Use and Intellectual Property
All content on this website, including but not limited to logos, branding, product images, graphics, text, layouts, designs and written content, is the property of the Company or its licensors and is protected by copyright and intellectual property laws.
No content from this website may be copied, reproduced, distributed, modified, republished or used for commercial purposes without prior written permission from the Company.
Unauthorised use of this website or its content may give rise to a claim for damages and/or constitute a criminal offence.
Discount Codes, Promotions and Subscription Terms
Discount codes, promotional offers and subscription discounts remain the property of the Company and may be withdrawn, amended or cancelled at any time without notice.
Discount codes may not be used in conjunction with other offers unless explicitly stated and may be subject to expiry dates, minimum spend requirements or product exclusions.
The Company reserves the right to refuse or cancel Orders where promotional codes have been used incorrectly, abusively or fraudulently.
Where subscription services or recurring discounts are offered, the Company reserves the right to amend pricing, benefits or terms with reasonable notice.
Misuse of promotions, loyalty schemes or referral offers may result in cancellation of discounts, Orders and/or customer accounts.
Force Majeure
If either party is subject to an event of Force Majeure, meaning circumstances outside its reasonable control including, but not limited to, war, fire, industrial disputes, civil commotion, natural disasters, supply chain disruption or courier delays, it shall notify the other party.
The affected party’s obligations under these Terms shall be suspended until the Force Majeure event has ended.
Competition Terms & Conditions
General
The Promoter is True Gent Tattoo Supplies.
Information on how to enter and prizes forms part of the terms of entry. Entry into the competition is deemed acceptance of these Terms and Conditions.
If there is any inconsistency between these Terms and Conditions and anything else that refers to this competition, these Terms and Conditions will prevail.
Who Can Enter
Entry is open to residents of the United Kingdom, except employees and immediate family members of the Promoter and their associated companies and agencies.
Entrants under 18 years of age must obtain prior permission from their parent or legal guardian to enter. If a winner is under 18 years of age, the prize may be awarded to their parent or legal guardian.
The Promoter reserves the right to request proof of identity, proof of residency, proof of age and/or proof of entry validity to claim a prize.
If a winner cannot provide suitable proof, they may forfeit the prize, and no substitute will be offered.
When to Enter
Entries must be received by the Promoter before the competition close date and time.
The time of entry will be the time the online entry is received by the Promoter, not the time of transmission by the entrant.
The Promoter accepts no responsibility for late, lost, incomplete or misdirected entries, or for delays caused by technical disruption, network congestion or any other reason.
How to Enter
Entrants may enter the competition by following the instructions given on the competition post on social media and/or the website.
As a condition of entering, entrants may be required to agree to receive email communications, announcements and special offers from True Gent Tattoo Supplies, where consent is lawfully obtained.
Entrants are responsible for ensuring that their entry complies with these Terms.
Entry content must be the entrant’s original work and must not include:
- any image or voice of another person without that person’s express consent;
- any content that breaks the law, infringes rights, or is insulting, inflammatory, defamatory, obscene, offensive, discriminatory, indecent or inappropriate;
- any copyrighted material unless the entrant has permission to use it.
The Promoter reserves the right to verify entries and disqualify any entry that cannot be verified to its satisfaction.
The Promoter may edit, modify, delete, remove or take down any part of an entrant’s entry at its discretion.
Any entry made on behalf of an entrant by a third party will be invalid unless the entrant requires assistance due to a disability.
The Promoter reserves the right to disqualify any entrant who tampers with the entry process or submits an entry that is fraudulent, misleading, deceptive or damaging to the goodwill or reputation of the Promotion or Promoter.
Number of Entries Permitted
Entrants may only enter once unless otherwise stated.
Only one prize will be awarded per household unless otherwise stated.
Draw and Notification of Winner
The winner will be selected from valid entries submitted in accordance with these Terms.
If a draw is scheduled on a public holiday, it may be conducted on the following business day.
The Promoter’s decision is final and no correspondence will be entered into.
The winner will be notified by telephone, email or social media within three days of the draw.
Prizes will be awarded to the person named in the entry.
If an entrant’s contact details change during the promotional period, it is the entrant’s responsibility to notify the Promoter.
Any prize unclaimed within 7 days may be redrawn or the competition may be closed.
Prize on Offer
Competition prizes may be subject to additional fees, including shipping, made-to-order costs, or minimum spend requirements, where stated.
Prize values are based on recommended retail prices at the time of publication. The Promoter accepts no responsibility for any change in prize value.
Prizes cannot be transferred, exchanged or redeemed for cash.
The winner must comply with all conditions of use of the prize and any supplier requirements.
The Promoter reserves the right to substitute the prize for a prize of equal or greater value if the original prize becomes unavailable.
Once the prize is awarded, the Promoter is not liable for any prize, ticket, voucher or delivery that is lost, stolen, damaged, forged or tampered with.
The winner is responsible for all additional expenses unless clearly stated otherwise.
Publicity and Content Rights
By entering, entrants agree that if they win, the Promoter may use their name, submission, image and/or voice for marketing, advertising and promotional purposes relating to True Gent Tattoo Supplies without further payment.
Each entrant grants the Promoter the right to use, modify, adapt, publish or share their entry content in connection with the competition and related marketing.
Entrants warrant that they have the necessary rights and permissions for any content submitted.
Further Terms and Conditions
The Promoter reserves the right to amend, cancel, suspend or terminate the competition if an event beyond its control affects the administration, security, fairness, integrity or proper conduct of the competition.
The Promoter accepts no responsibility for any error, omission, interruption, deletion, defect, delay, technical failure, theft, destruction or unauthorised access to entries.
If the competition cannot run as planned due to viruses, bugs, tampering, unauthorised intervention, fraud, technical failures or other causes beyond the Promoter’s control, the Promoter may cancel, terminate, modify or suspend the competition.
Entrants are responsible for any costs associated with accessing the promotional website or social media platform.
The Promoter reserves the right to disqualify any individual who breaches these Terms or engages in unlawful or improper conduct.
All entries become the property of the Promoter.
The Promoter collects personal information for the purposes of conducting the competition and administering prizes.
Personal information may be used in accordance with the Promoter’s Privacy Policy and applicable data protection laws.
Marketing communications will only be sent where the entrant has opted in or where otherwise permitted by law.
Entrants may request to update, modify or delete their details by contacting the Promoter.
